In an effort to assist my clientele and inform the community-at-large, I offer the following basic information about the will creation process.  This is information that should be brought to the first meeting with any estate planning attorney retained, to cut down on time (and thus cost) to you.

 

1.                  Your full name and current address.

2.                  The full names and current addresses of everyone named in:

a.       the Last Will and Testament (the document that directs the disposition of your personal and real property existing now or in the future, and which grants custody of any minor children to specific individuals).  Individuals named in the Last Will and Testament typically include:

                                                              i.      The Testator (you).

                                                            ii.      The Beneficiaries (those to whom you are transferring your property upon death).  This should include the details of any specific gifts to individuals (ie, grandma’s afgan to sister).

                                                          iii.      The Executor (the individual who will be responsible for taking your Last Will and Testament through the probate process.).  This should be someone you trust to carry out your instructions to the letter, and, ideally, someone familiar with the probate process.

                                                          iv.      The Guardian (the individual who will be granted physical if not legal custody of any children still minors at the time of your death.).

b.      the Testamentary Trust (the document that bestows conditioned control over any gifts of money, stocks, etc. to a minor.).  Individuals named in the Testamentary Trust typically include:

                                                              i.      The Settlor (you).

                                                            ii.      The Beneficiaries (those who are intended to benefit by virtue of the trust’s construction, ie, any minor children).

                                                          iii.      The Trustee (the individual who will be granted conditioned control over the funds in the trust (ie, the proceeds from your estate) until specific events occur (ie, last of beneficiaries reaches age 30).

c.       the Power of Attorney (the document that names individuals who will have the ability to make legal and financial decisions for you in the case of incapacity).  Individuals named in the Power of Attorney typically include:

                                                              i.      Attorney-in-fact (the individual who will make legal and financial decisions for you in the event of your incapacity.).  Again, it should be someone you trust implicitly, and, moreover, someone who knows what you would do were you able.  It is advisable to name two individuals, an attorney-in-fact and an alternate, in the event that the primary is unable to serve.

d.      and the Health Care Proxy (the document that names individuals who will have the ability to make medical decisions for you in the case of incapacity).  Individuals named in the Health Care Proxy typically include:

                                                              i.      Health Care Agent (the individual who make medical decisions for you in the event of your incapacity.).  Any specific conditions (ie, no life support) should be made known to your Health Care Agent and prior to the execution of the Proxy.  It is advisable to name two or more individuals to provide alternate health care agents in the event that one or more are unable or unwilling to serve.
